1. Preamble

Welcome to the MACIPOLISYS mobile application and related services ("App", "Platform", "we", "our", or "us"). MACIPOLISYS is a digital platform intended to facilitate membership, communication, volunteering, participation in programmes, surveys, events, grievances, and other activities associated with the organisation.

These Terms and Conditions ("Terms") govern your access to and use of the App, website, features, services, content, and functionalities made available through MACIPOLISYS.

By downloading, installing, registering for, accessing, or using the App or any of its services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the applicable Privacy Policy.

If you do not agree with these Terms, you must not access or use the App or its services.

2. Definitions

"App" means the MACIPOLISYS mobile application and any related digital services made available by us.

"User" or "you" means any individual who downloads, installs, registers, accesses, or uses the App.

"Membership" means the membership or participation status associated with a registered User within the Platform.

"Content" includes text, photographs, videos, audio, documents, comments, feedback, survey responses, messages, and other materials made available through or submitted to the Platform.

"Applicable Law" means all applicable laws, rules, regulations, orders, directions, and governmental requirements applicable to the Platform and its Users in India.

3. Eligibility to Use the App

You may use the App only if you are legally capable of entering into a binding agreement under Applicable Law.

The App is not knowingly intended for children. Where use by a child or a person requiring lawful guardian consent is permitted, such use shall be subject to applicable legal requirements and verifiable consent where required.

By registering or using the App, you represent that the information provided by you is accurate, complete, and up-to-date.

4. Account Registration and Authentication

Certain features of the App may require you to create an account or provide information for registration and verification.

You are responsible for providing accurate information and for maintaining the confidentiality and security of your account credentials and authentication information.

Where OTP-based authentication is used, you must not share the OTP or authentication credentials with any other person.

You must immediately notify us if you believe that your account has been accessed without authorization or that your account information has been compromised.

5. Membership and Participation

The App may allow eligible Users to register for membership, participate in organisational activities, volunteer programmes, events, surveys, campaigns, and other activities made available through the Platform.

Submission of a membership application does not necessarily guarantee acceptance or continuation of membership. Membership may be subject to verification and applicable organisational rules and requirements.

Users participating as volunteers, karyakartas, coordinators, or other representatives must follow applicable organisational guidelines and instructions.

6. User Responsibilities

You agree to use the App responsibly, lawfully, and only for its intended purposes.

You must not:

• provide false, misleading, fraudulent, or impersonated information;
• create an account using another person's identity or credentials;
• access or attempt to access another User's account without authorization;
• interfere with or disrupt the operation, security, or availability of the App;
• introduce malware, viruses, malicious code, or other harmful material;
• attempt to reverse engineer, decompile, modify, or extract source code from the App except where expressly permitted by law;
• scrape, copy, reproduce, distribute, or commercially exploit Platform data without authorization;
• use the Platform for unlawful, fraudulent, abusive, or misleading activities; or
• violate the rights of other Users or any third party.

7. User-Generated Content

The App may allow Users to submit feedback, grievances, survey responses, opinions, comments, photographs, audio, videos, and other content.

You remain responsible for the content that you submit through the App and represent that you have the necessary rights and permissions to submit such content.

You must not submit content that is unlawful, defamatory, threatening, abusive, obscene, fraudulent, discriminatory, misleading, or infringes the intellectual property, privacy, or other rights of another person.

By submitting content, you grant MACIPOLISYS the limited right to store, process, display, and use such content for the purposes for which the relevant feature of the App is provided, subject to the Privacy Policy and Applicable Law.

8. Communications and Organisational Activities

The Platform may be used to communicate organisational news, programmes, events, campaigns, membership information, surveys, volunteer opportunities, public representations, and other relevant information.

Communications made through the Platform shall be subject to Applicable Law and any directions, regulations, or guidelines issued by competent authorities.

Users must not misuse the Platform to distribute unsolicited, fraudulent, misleading, or unlawful communications.

Where applicable, political communications shall comply with requirements issued by the Election Commission of India and applicable telecommunications and election laws.

9. Surveys, Events, Polls and Programmes

The App may provide access to surveys, opinion polls, events, programmes, volunteer activities, and other participation features.

Participation in any such activity may be subject to additional eligibility criteria, instructions, schedules, availability, or other conditions communicated at the relevant time.

Submission of responses or participation in a survey, poll, or event does not guarantee any particular outcome, appointment, benefit, or opportunity.

10. Grievances and Public Representations

Users may be provided with features to submit grievances, requests, complaints, feedback, or public representations.

Users should provide complete and accurate information when submitting a grievance or request.

Submission of a grievance does not guarantee acceptance of the claim or a particular resolution. Requests may be reviewed and handled according to applicable procedures and requirements.

11. Privacy and Personal Data

Your use of the App is also governed by the MACIPOLISYS Privacy Policy, which explains how Personal Data is collected, used, stored, processed, disclosed, and protected.

The Privacy Policy forms an integral part of these Terms and should be read together with them.

The App may process information relating to identity, contact details, membership, volunteering, electoral information, communications, device information, usage information, and location where permission has been provided, as described in the Privacy Policy.

12. Third-Party Services and Links

The App may contain links to or integrations with third-party websites, applications, platforms, payment services, communication services, authentication providers, or other services.

Third-party services may operate under their own terms and privacy policies. MACIPOLISYS does not control and is not responsible for the content, availability, security, or privacy practices of third-party services.

Users are encouraged to review the applicable terms and privacy policies before using third-party services.

13. Intellectual Property

Unless otherwise stated, the App and its software, design, layout, graphics, logos, trademarks, text, images, functionality, and other materials are protected by applicable intellectual property laws.

You may use the App only for its intended purpose and in accordance with these Terms.

You may not reproduce, modify, distribute, publicly display, commercially exploit, or create derivative works from Platform content without appropriate authorization, except where permitted under Applicable Law.

14. Security

We take reasonable measures to maintain the security and integrity of the Platform. However, no electronic transmission, storage system, or internet-based service can be guaranteed to be completely secure.

Users acknowledge that they use the App at their own risk to the extent permitted by Applicable Law and are responsible for maintaining the security of their own devices and credentials.

15. Availability of Services

We may modify, suspend, restrict, or discontinue any feature or part of the App from time to time for maintenance, security, operational, technical, legal, or other legitimate reasons.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system.

16. Suspension and Termination

We may suspend, restrict, or terminate your access to the App where we reasonably believe that you have violated these Terms, Applicable Law, security requirements, or applicable organisational rules.

Access may also be restricted where necessary to prevent fraud, impersonation, unauthorized access, misuse, or harm to the Platform or other Users.

Termination or suspension shall not affect rights or obligations that are intended to survive termination.

17. Disclaimer

The App and its services are provided on an "as available" basis to the maximum extent permitted by Applicable Law.

While reasonable efforts may be made to maintain accurate and reliable information, MACIPOLISYS does not warrant that all content or information available through the Platform will always be complete, accurate, current, or free from errors.

Users should independently verify information where necessary before relying upon it.

18. Limitation of Liability

To the maximum extent permitted by Applicable Law, MACIPOLISYS shall not be liable for indirect, incidental, consequential, special, or punitive losses arising from your use of or inability to use the App.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under Applicable Law.

19. Indemnification

To the extent permitted by Applicable Law, you agree to indemnify and hold harmless MACIPOLISYS, its authorized representatives, officers, employees, and service providers from claims, losses, liabilities, damages, and expenses arising from your unlawful use of the App, violation of these Terms, or infringement of the rights of another person.

20. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in the App, applicable laws, technology, organisational practices, or other requirements.

Updated Terms will be made available through the App or website with an updated "Last Updated" date.

Where required by Applicable Law, material changes may be communicated through appropriate channels.

Your continued use of the App after the updated Terms become effective constitutes acceptance of the revised Terms, subject to Applicable Law.

21. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to any mandatory statutory grievance or dispute resolution mechanism under Applicable Law, courts and tribunals having jurisdiction in Bengaluru, Karnataka, India shall have jurisdiction over matters arising from or relating to these Terms.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with the MACIPOLISYS Privacy Policy and any additional terms expressly applicable to particular features or services, constitute the terms governing your use of the Platform.

If you have questions, concerns, complaints, or requests relating to these Terms or your use of the Platform, you may contact MACIPOLISYS through the official contact channels provided within the App or on the official website.

Requests relating specifically to Personal Data and privacy rights should be submitted through the mechanisms described in the MACIPOLISYS Privacy Policy.
